PRIVACY POLICY
Taymor Industries Ltd. (“we,” “our,” or “us”) is committed to protecting your privacy and safeguarding the personal information in our custody or control. This Privacy Policy tells you how we collect, use, store, transfer and disclose your personal information when you visit our Website or Taymor mobile applications (“Apps”), or “Services.”

This Policy does not apply to any personal information we collect for employment or recruitment purposes.

By using our Services after you have been informed of this Policy, you acknowledge and agree that your personal information will be collected, used, and disclosed in accordance with this Privacy Policy, as amended from time to time.

Personal information means any information that is about an identifiable individual (which means any information that can identify an individual directly or in combination with other information).

COLLECTION OF PERSONAL INFORMATION
When you make a purchase or create an account on our Website, we may ask you for the following personal information to complete your request: first name, last name, telephone number, mailing address and email address. Also, if you place an order over the phone, our customer service team may also ask for your credit card information to fulfill your order and make notes associated with your order.

We may also ask you for your name and email address to create your Website account profile for our My Projects service. The My Projects feature allows you to add products to a project list in your account.

Our collection of personal information is limited to that which is reasonably necessary under the circumstances, and we only collect your personal information with your consent, which may be express or implied under the circumstances, unless otherwise permissible or required by law.

We may also collect anonymous aggregate information on what pages you access or visit. The aggregate information we collect is used for many different purposes in order to serve you better. Among these purposes is to improve the content of the Website and to customize the content and/or layout of the Website for each individual visitor.

HOW WE MAY USE YOUR PERSONAL INFORMATION
We use personal information for the purposes stated or implied at the time of collection, including for the following purposes:

  • Confirming your identity

  • Responding to your inquiries

  • Meeting the legal and regulatory requirements applicable to us

  • Processing product related complaints

  • Fulfilling product orders, and

  • With your consent, marketing of our products and services to you, as well as those of our affiliates and third parties.

We may otherwise use your personal information where permissible by law, for example to respond to an emergency, or in the course of an investigation into illegal behaviour.

We limit access to your personal information to that what is required for the particular purposes for which the information was collected.

APPLICATION DATA
If you use our Taymor Protect app, and only with your prior consent, we also may collect the following information if you choose to provide us with access or permission:

  • Geolocation Information - We may request access or permission to track location-based information from your mobile device, either continuously or while you are using our mobile application(s), to provide certain location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

  • Mobile Device Access - We may request access or permission to certain features from your mobile device, including your mobile device’s bluetooth, camera, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

  • Push Notifications - We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings.

MARKETING & PROMOTIONAL MESSAGE
Where applicable, we will seek your express consent to contact you, including by way of commercial electronic messages (email or text message).

This consent is sought by Taymor Industries Ltd. and you can contact us by phone at 1.800.267.4774 or in person at 1655 Derwent Way, Delta, BC  V3M 6K8, Canada. You can unsubscribe at any time from receiving commercial electronic messages by following the instructions in the message.

Even if you have opted out of receiving marketing communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the products or services we provide to you, or if you contact us with an inquiry.

TRANSFERS & DISCLOSURES OF PERSONAL INFORMATION
We will not disclose personal information to any external organization without your consent unless we are required or permitted to do so by law, including in the event of a corporate amalgamation, reorganization, change of control or sale.

We may also share personal information with contractors, service providers, third-party processors and other parties we use to deliver the Services. These providers assist us with information technology, data hosting, marketing, and transportation and shipping providers handling products you order from us.

Your personal information may be stored, processed or otherwise used by us, our affiliates or our service providers, both inside and outside Canada/Quebec. As a result, that country's courts, governments or law enforcement agencies could obtain disclosure of your information in accordance with that foreign jurisdiction's laws. Whenever we hire other organizations to provide support services, they will be required by contractual and other means to conform to our privacy standards and to allow us to audit them for compliance.

SECURITY & RETENTION
We take all reasonable steps to protect the security and confidentiality of your personal information. We protect the personal information within our custody or control with appropriate organizational, technological and physical safeguards.

We store personal information in electronic and physical files that are secure, and our security measures include secure on- and off-site storage, restricted access to records and data processing equipment, password protocols, and encryption and security software. We conduct audits and monitor compliance with our privacy practices.

We only retain personal information for as long as is necessary for the purpose for which it was collected. When we no longer are required to retain the information, we will destroy, erase, or de-identify the information. Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold.

MINORS
It is our intention to comply with all applicable laws regarding children’s privacy and advertisements that target them. We will not knowingly collect personal information about minors under 14 years of age without the verified consent of the parent/legal guardian.

COOKIES
We may use "cookie" technology to obtain data from visitors to the Website. Cookies are pieces of information stored on a user's computer by a website so preferences are remembered on future requests. Pixel tags (also known as web bugs, web beacons, clear/invisible/tracker GIFs) are signals sent from certain websites or e-mails used to pass certain information to our servers to personalize the Website and to track your usage. Cookies and pixel tags are used to optimize the performance and functionality of the Website, and to personalize the Website for you and present you with content and offers specific to your interests.

We do not extract personal information in this process nor do we provide this information to third parties. ANALYTICS
We may also use third-party service providers to monitor and analyze the use of our Website. Google Analytics is a web analytics service offered by Google Inc. (“Google”) that tracks, monitors and reports traffic on our Website. Google tracks information like (i) your IP address; (ii) the type of web browser and operating system being used; (iii) the pages of the Website that you visit; and (iv) other websites you may have visited before visiting our Website. Google may also transfer this information to other third parties where they are required to do so by law, or where such third parties process the information on their behalf. Google’s practices with respect to the personal information collected through Google Analytics are covered by Google’s Privacy Policy. You may opt-out of Google Analytics here.

The Website may contain links to other websites operated by third parties. Please note that this Privacy Policy applies only to the personal information that we collect or receive from third parties with your consent and we cannot be responsible for personal information that third parties may collect, store and use, including through their websites. You should always read the privacy policy of each website you visit carefully.

CHANGES TO THIS PRIVACY POLICY
We may amend this Privacy Policy from time to time as we add new products and services, as we improve our current offerings, and as technologies change. If we make a change to this Privacy Policy this will be reflected in the above “Last Updated” date. We encourage you to check back periodically to see if we have made any changes. If we make any material or substantive changes in this Privacy Policy, we will notify you by posting a clear and conspicuous notice of these changes on the Website and in this Privacy Policy.

We will consider your continued sharing of personal information acceptance of any such changes to the Policy upon them entering into force.

YOUR RIGHTS
Subject to the limits and provisions of applicable laws, you have the right to:

  • Access your personal information;

  • Correct or update your personal information;

  • Withdraw your consent at any time (the withdrawal of consent is binding for us with regard to the personal information the use of which was based on such consent; the withdrawal of consent will not affect the lawfulness of use based on your consent before its withdrawal);

  • Request the deletion of your personal information if it is outdated or not justified for the purposes it was collected.

If you submit a request to withdraw your consent to use, disclose and store your personal information, how we handle that request will depend on the situation and reasons. Depending on the situation:

  • You may withdraw your consent, but we will no longer be able to provide you a service or product that requires such consent;

  • You may not withdraw your consent because processing your personal information is necessary or mandatory.

In either case, we may be legally required to retain certain personal information.

You may exercise the foregoing rights at any time by contacting our Privacy Officer (see below). Any such request must contain sufficient details for us to be able to address it. We undertake to respond to any such request within a reasonable period of time, and to the extent possible, within a maximum of thirty (30) days, as set out in the applicable laws. We must, however, first verify the identity of the person making such a request.

We will ensure that your personal information is as accurate, complete and up-to-date as possible for the purposes for which it is used. However, it is your responsibility to advise us of changes to your personal information, such as your contact information.

CALIFORNIA RESIDENTS
In addition to the rights above, under California Civil Code Section 1798.83, known as the “Shine the Light” law, users who are California residents may request and obtain from us, free of charge, a list of any personal data and a description of the categories of personal data we disclosed to third parties for their own direct marketing purposes in the preceding calendar year, and the names and addresses of those third parties. To make such a request, please send an email to NNogales@taymor.com and please include the phrase "Personal Information Privacy Request" in the subject line, the domain name of the website(s) you are inquiring about, along with your name, address and email address. At our option, we may respond to such requests by providing instructions about how our users can exercise their options to prevent our disclosure of personal data to third parties for their direct marketing purposes.
